AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Current law erroneously directs the executive director of the Texas Department of Licensing and Regulation (TDLR) to administer and enforce the entire chapter of the code regulating radioactive materials and other sources of radiation, which fall under the purview of other agencies, instead of focusing solely on the relevant Laser Hair Removal subchapter. What's more, the law includes redundant subsections requiring TDLR to include warning signage information in license applications, despite the availability of more efficient communication methods.
S.B. 748 would address these issues by clarifying TDLR's enforcement authority, limiting it to the Laser Hair Removal subchapter, which would reduce confusion and ensure more efficient oversight. It also would streamline the statute by removing duplicative rulemaking requirements for signage, making the law clearer and more concise. What's more, it would simplify licensing processes by eliminating the mandate to include warning signage information in applications, allowing TDLR to provide this information through more practical and effective methods.

RULEMAKING AUTHORITY
Rulemaking authority previously granted to the Texas Commission of Licensing and Regulation is rescinded in SECTION 2 (Section 401.516, Health and Safety Code) of this bill.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 401.5011, Health and Safety Code, as follows:
Sec. 401.5011.� GENERAL POWERS AND DUTIES. Requires the executive director of the Texas Department of Licensing and Regulation (TDLR) to administer and enforce Subchapter M (Laser Hair Removal), Chapter 401 (Radioactive Materials and Other Sources of Radiation), rather than Chapter 401.
SECTION 2. Repealer: Sections 401.516(b) (relating to requiring the Texas Commission of Licensing and Regulation to adopt rules specifying the size, content, and design of the sign) and (c) (relating to requiring TDLR to include with a license application and an application for renewal of a license a description of the design standards required for a sign), Health and Safety Code.
SECTION 3. Effective date: September 1, 2025.
