Relating to the operation of certain metropolitan transit authorities.

Contracts

• Interlocal Agreements (Mandatory): To allow police, fire, or EMS vehicles to use Transit Authority CNG/LNG pumps without voiding the Authority's tax exemption, you must execute an agreement under Chapter 791, Government Code.
• Indemnification Clauses: These agreements must explicitly address liability for third-party government vehicles operating on Transit Authority premises.
• Board Member Contracts: Legal counsel must review current board member tenures. Service to fill a vacancy or an unexpired term no longer counts toward term limits, potentially extending the eligibility of current directors.

Hiring/Training

• Fuel Station Protocols: Facility managers must be trained on "Switch-Over Protocols." Staff must know exactly when they are authorized to unlock pumps for non-transit government vehicles.
• Strict Access Control: Personnel must ensure that access remains restricted to the general public to prevent a total loss of the tax exemption under Tax Code 162.356.

Reporting & Record-Keeping

• Exigent Circumstance Logs: You must implement a logging system (digital or physical) that captures the date, time, specific vehicle ID, and the nature of the emergency for every non-transit vehicle fueled.
• Audit Trail: These records must be retained for four years to satisfy Comptroller audits proving the facility was not "open to the public."

Fees & Costs

• Fare Implementation: The statutory 60-day waiting period for fare changes is repealed for most adjustments. Fare changes now take effect immediately upon Board approval.
• Exception: Changes to the "single-ride base fare" still require a 60-day delay.
